These Terms of Service ("Terms") govern your use of the Busted mobile application and related services ("Busted," "we," or "our"). By using Busted, you agree to these Terms.
1. Service Overview
Busted allows users to scan, manage, pay, and dispute parking tickets. Service availability varies by location:
Providence, Rhode Island: Payment services only. A platform fee is displayed before payment is processed.
Greater Boston area (Boston, Cambridge, Somerville, Brookline): Ticket dispute + payment services.
We may add support for additional cities at any time.
2. Independent Service
Busted is not affiliated with any city, government agency, parking authority, or law enforcement organization. We operate independently as a private service provider.
3. Eligibility
To use Busted, you must:
Be at least 18 years old
Provide accurate ticket and contact information
Be the ticketed vehicle owner or have permission to manage/dispute the ticket
4. No Legal Advice
Busted is not a law firm and does not provide legal advice. We do not review your individual situation or advise on legal rights. If you need legal advice, consult a licensed attorney.
5. Authorized Agent Consent (Disputes)
For dispute services in supported areas, you authorize Busted LLC to act as your limited authorized agent to:
Prepare and submit ticket disputes using the information you provide
Communicate with municipal agencies regarding your dispute
Receive dispute-related correspondence via our business address or virtual mail provider
Upload or forward dispute responses to you through the app
This authority is limited to document preparation and submission only — not legal representation.
6. "Only Pay If You Win" – Dispute Billing
For disputes in supported regions, Busted uses a success-based billing model:
You only pay if you win your dispute.
A win means:
Your ticket is fully dismissed OR
Your fine is reduced by the city
Success fee = 50% of the amount you save
Example (dismissal): $90 ticket dismissed, you pay $45
Example (reduction): $100 to $40 reduction and you save $60, you pay $30
If your dispute is not successful, you pay $0
Success fees are final and non-refundable, except in cases of billing error
7. Payment Authorization (Required)
By submitting a dispute, you:
Authorize Busted to securely store your payment method
Authorize off-session billing (charging your card later when your dispute result is received)
Agree that charges may occur weeks or months after submission due to city processing times
Agree that providing a payment method constitutes signed authorization for future charges if you win
8. Payments and Platform Fees
Busted allows users to pay parking tickets in all supported cities. A clearly displayed platform fee applies before Busted processes a payment. This fee is shown during checkout and is separate from any government-imposed ticket amount, late fee, or penalty. All platform fees are final once a payment is submitted.
9. Chargebacks and Fraud
By using Busted, you agree not to dispute or reverse valid success fee charges. You understand:
A municipal decision document is proof of service completion
A dispute decision confirming dismissal or reduction authorizes billing
Filing a false chargeback after agreeing to these Terms may be treated as fraud
10. User Responsibilities
You agree to:
Provide accurate ticket information
Submit disputes before city deadlines
Check your dispute status and any balance owed to the city
Respond to requests for additional information when needed
Not misuse the platform for fraudulent or illegal activity
You are responsible for any penalties if you submit incorrect or late information.
11. Communication Consent
You consent to receive communications from Busted electronically, including:
Dispute status updates
Payment confirmations
Requests for additional information
Appeals or follow-up steps
12. Account and Security
You are responsible for maintaining the confidentiality of your account and for all actions taken under your account. You must notify us immediately of unauthorized access.
13. Service Availability
We do not guarantee continuous or uninterrupted service. Busted may pause, modify, or discontinue services at any time.
14. Limitation of Liability
To the fullest extent permitted by law:
Busted is not responsible for municipal decision delays, lost mail, technical issues, or government errors
Busted does not guarantee dispute outcomes
Our total liability is limited to the amount you paid us, if any
15. No Warranty
Services are provided "as is" and without warranty of any kind. We do not guarantee approval, dismissal, or reduction of any ticket.
16. Termination
We may suspend or terminate your access to Busted at any time for misuse, fraud, non-payment, abuse of support, or violation of these Terms. You may stop using Busted at any time. Termination does not cancel any pending success fee you owe from a previously won dispute.
17. Arbitration Agreement
You agree that any dispute between you and Busted will be resolved through binding individual arbitration, not in court. You waive your right to a jury trial or class action.
Arbitration will be conducted by the American Arbitration Association (AAA)
Each party pays its own costs
The arbitrator's decision is final
This section survives termination of your account.
18. Indemnification
You agree to indemnify and hold Busted harmless from any claim arising from incorrect information you provide, misuse of the Service, or violation of these Terms.
19. Privacy
Your information is handled according to our Privacy Policy. By using Busted, you consent to data storage and processing, including the use of virtual mail and dispute documentation.
20. Changes to Terms
We may update these Terms from time to time. Continued use of Busted means you accept the updated Terms.
21. Entire Agreement
These Terms constitute the entire agreement between you and Busted and supersede any prior agreements. If any provision is found unenforceable, the rest still applies.
